Dear Sir or Madam, 

thanks a lot for your mail and for voicing the concerns about ACTA, which we
fully share! 

The Anti-Counterfeiting Trade Agreement (ACTA) would indeed strengthen
intellectual proprety rights holders' means for privatised policing, while
protections for users are not adequately enforced. It would introduce
voluntary cooperation between internet access providers and rights holders,
creating a danger of French-like "3-strikes" penalties even without due
judicial process. Even the European Court of Justice in its ruling of 24
November 2011 said that blocking or filtering internet acces is not an
appropriate measure for fighting copyright violations. ACTA would also
impose civil damages for file-sharing that are disproportionate, because
they may be only based on the retail value of shared files, without any
assessment of the real loss in sales. ACTA also will make access to
generical pharmaceuticals more difficult for developing countries if they
are shipped through harbours of ACTA signatories such as Europe or the
United States. 

ACTA was only started because some industrialised countries could not
continue their IPR enforcement agenda in legitimate multilateral
organisations such as WIPO or WTO anymore, because of resistance by
developing countries and emerging economies. So they moved towards
closed-door secret negotiations with a coalition of the willing. ACTA
negotiation documents have still not been made public, and the draft
negotiation texts have only been released after heavy pressure from the
European Parliament.

Greens/EFA in the European Parliament have been fighting this dangerous
agreement for the last two years. We commissioned two studies on its impact
on fundamental rights and on access to medicine, which clearly show the
dangers of ACTA. We have worked closely with the NGO and activist community,
and we have taken the necessary steps to clarify how ACTA can be sent to the
European Court of Justice. You can find all information about our activities

Now that the EU Council presidency and a number of member states have signed
the agreement, the European Parliament will start dealing with the ACTA
ratification procedure. Most crucial will be the committees LIBE (civil
liberties), JURI (legal affairs) and INTA (international trade - leading
committee on ACTA). 

If you want to help, we suggest you contact especially liberal (ALDE) and
social-democrat (S&D) MEPs in these committees, as it is not clear yet how
these political groups will vote in the end. Your request to them can make a

Sehr geehrte Damen und Herren, 

vielen Dank für die Mail und dafür, die Besorgnis über ACTA auszudrücken,
die wir von ganzem Herzen teilen! 

Das Anti-Counterfeiting Trade Agreement (ACTA) würde in der Tat die
Möglichkeiten der Inhaber von geistigen Eigentumsrechten zur privatisierten
Durchsetzung ihrer Interessen stärken, während die Schutzbestimmungen für
die NutzerInnen nicht in gleichem Maße berücksichtigt würden. Es würde eine
freiwillige Zusammenarbeit zwischen internet-Zugangsanbietern und
Rechteinhabern einführen, mit nder Gefahr, dass es zun französischen
"3-strikes" Strafmaßnahmen sogar ohne faires rechtliches Verfahren kommt.
Sogar der Europäische Gerichtshof hat am 24. November 2011 entschieden, dass
das Blockieren oder Filtern des Internet-Zugangs keine angemessene Maßnahme
für die Bekkämpfung von Urheberrechtsverletzungen darstellt. ACTA würde auch
unverhältnismäßige zivile Schadensersatzansprüche einführen, die sich
lediglich nach dem Verkaufswert von getauschten Dateien bemessen und nicht
daran, ob diese Dateien ansonsten jemals entsprechend oft gekauft worden
wären. ACTA würde auch den Zugang zu generischen Medizinprodukten für
Entwicklungsländer erschweren, wenn sie durch Häfen in
ACTA-Unterzeichnerstaaten verschifft werden, also etwa durch Europa oder die
USA.

ACTA wurde nur gestartet, weil einige Industriestaaten ihre Agenda zur
Durchsetzung des geistigen Eigentums in legitimen multilateralen
Institutionen wie WIPO oder WTO nicht mehr durchsetzen konnten aufgrund
wachsenden Widerstandes durch Entwicklungs- und Schwellenländer. Daher sind
erstere zu einer Koalition der Willigen übergegangen, die mehr als zwei
Jahre lang Geheimverhandlungen führte. Die ACTA-Verhandlungsunterlagen sind
bis heute nicht öffentlich, und die Entwürfe des Abkommens wurden erst auf
massiven Druck des Europäischen Parlaments hin veröffentlicht. 

Die Grünen/EFA im Europäischen Parlament haben dieses gefährliche Abkommen
über die letzten zwei Jahre bekämpft. Wir haben zwei Studien in Auftrag
gegeben, um die Auswirkungen auf die Grundrechte und auf den Zugang zu
Medizin zu untersuchen, welche klar die großen Probleme und Gefahren von
ACTA nachgewiesen haben. Wir habven eng mit der NGO- und
AktivistInnen-Community zusammengearbeitet, und wir haben alle notwendigen
Schritte unternommen, um zu klären, wie ACTA dem Europäischen Gerichtshof

Jetzt, da die EU-Ratspräsidentschaft und einige Mitgliedsstaaten das
Abkommen unterzeichnet haben, wird sich das Europäische Parlament wird sich
mit der Ratifizierung von ACTA befassen. Am wichtigsten werden die
Ausschüsse LIBE (Bürgerrechte), JURI (Recht) and INTA (internationaler
Handel - federführend zu ACTA) sein.

Wenn Du helfen willst, dann raten wir dazu, vor allem liberale (ALDE) und
sozialdemokratische (S&D) Abgeordnete in diesen Ausschüssen zu kontaktieren,
denn es ist bisher unklar, wie diese Fraktionen sich am Ende verhalten
werden. Deine Stimme kann hier einen wichtigen Unterschied machen! Vielen
